Falls Township and surrounding communities will be able to view the so-called curative amendment related to data center regulations later this week.
Falls Supervisors Chairman Jeff Dence announced that officials are finalizing potential modifications to the zoning ordinance and expect it to be available for public review beginning this week through Nov. 23, the date of the board’s next regular monthly meeting. The amendment will be posted on the township’s website by Friday.
The Supervisors are planning to discuss the proposed zoning changes during the Nov. 23 meeting. From there, the proposed ordinance changes would be advertised in December with adoption following in the new year, Dence said.
Township Manager John Shepherd explained to residents inquiring that, if adopted, the ordinance would govern future data centers proposed for Falls Township.
“It doesn’t go backwards,” Shepherd said. “It goes forward.”
In July, following a widely attended and contentious community meeting for the Amazon data center, the Supervisors approved a resolution declaring a portion of the zoning ordinance “substantively invalid.”
Commonly referred to as a “curative amendment,” township attorney Lauren Gallagher previously called it a “protective measure for any substantive validity challenge” that would potentially be filed within the 180-day period that the township has designated for review and possible changes to its zoning ordinance.
The curative amendment would have no impact on Amazon’s data center, which was approved in March 2025 and has been under construction for some time.
